The fine print, kept plain.

These terms govern access to and use of Bottega, the webinar funnel platform operated by GOATEDX (“GOATEDX”, “we”, “us”), including the console at bottega.goatedx.com, the landers published with it and related emails and integrations (the “Service”).

Bottega is available by invitation only to organisations GOATEDX works with (“clients”) and the people they or we invite (“users”). By accepting an invitation or using the Service you agree to these terms. If you use Bottega for an organisation, you confirm you are authorised to accept these terms for it.

If GOATEDX and a client have signed a separate agreement, proposal or statement of work, that document takes priority where it conflicts with these terms.

• Each account is for one named person. Don't share sign-in links, codes or passwords.
• Keep your credentials secure and tell us promptly at bottega@goatedx.com if you suspect unauthorised access.
• Workspace admins decide who joins their workspace and with which role, and are responsible for removing people who should no longer have access.
• You are responsible for activity under your account and within your workspace, except where it results from our failure to secure the Service.

You own your content: landers, copy, images, brand assets, email templates and the registrant data you collect. You give GOATEDX a limited licence to host, copy, process and display that content only as needed to provide, secure and support the Service.

For registrant data, you are the data user (controller) and GOATEDX is your data processor, as described in our privacy policy. You are responsible for:

• Having a lawful basis, and consent where required, to collect registrants' details and to contact them by email, WhatsApp or other channels.
• Showing a clear privacy notice and consent line on your landers. We provide a suggested one at bottega.goatedx.com/privacy#registrants.
• Deciding whether to enable ad tracking such as the Meta pixel and Conversions API, and meeting the consent rules that apply to it.
• Honouring requests from registrants, with our help where needed.

You agree not to use the Service to:

• Break any law, or infringe anyone's intellectual property, privacy or other rights.
• Publish misleading or deceptive content, including unsubstantiated income, health or results claims.
• Send spam or messages to people who haven't agreed to hear from you, or ignore unsubscribe requests.
• Collect sensitive personal data (such as health, financial account or government ID details) or data from children, unless agreed with GOATEDX in writing.
• Break the policies of connected platforms such as Meta, Zoom or our email provider.
• Upload malware, probe or load-test the Service, bypass its security or access controls, or scrape data you are not entitled to.
• Copy, resell or reverse engineer Bottega, or use it to build a competing product.

We may remove content or restrict access that breaks these rules, and will tell you why unless the law or a security risk prevents it.

Bottega connects to services such as Meta, Zoom, Resend and domain providers. Your use of them is governed by their own terms. GOATEDX isn't responsible for their availability, policy changes or decisions (for example an ad account restriction or a Zoom outage), though we will help where we reasonably can.

Fees for Bottega, if any, are set out in your agreement or proposal with GOATEDX. If invoices are overdue, we may pause access after giving notice. Pausing access doesn't delete your data.

We work to keep Bottega fast, secure and available, but we don't guarantee uninterrupted or error-free operation unless agreed in writing. We may carry out maintenance and improve, change or retire features. If a change materially reduces what you rely on, we will give you reasonable notice.

• Either side can end the engagement as set out in your agreement with GOATEDX.
• We may suspend access immediately if there is a security risk, a serious breach of these terms, or a legal requirement.
• When access ends, you can ask for an export of your registrants and results within 30 days. After that, we delete workspace data as described in our privacy policy.
• Sections that by their nature should survive, such as ownership, confidentiality, liability and governing law, continue after termination.

Each side will keep the other's non-public information confidential and use it only for the engagement. This doesn't cover information that is already public, independently developed or lawfully received from someone else, or that must be disclosed by law.

Bottega's software, design, documentation and brand, and the GOATEDX name, belong to GOATEDX or its licensors. These terms give you a limited, non-exclusive, non-transferable right to use the Service during your engagement. If you send us feedback, we may use it to improve Bottega without obligation to you.

Bottega helps you run and measure webinar funnels, but results depend on many things outside our control. Analytics, attribution and attendance figures are best estimates based on the data available. We don't promise any level of ad performance, registrations, show-up rates, deliverability or sales. To the extent the law allows, the Service is provided “as is” without implied warranties.

To the extent the law allows:

• Neither side is liable for indirect or consequential loss, or for lost profits, revenue, ad spend or goodwill.
• GOATEDX's total liability arising from the Service is limited to the fees you paid GOATEDX for Bottega in the 12 months before the claim.
• Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud.

You agree to cover GOATEDX for claims arising from your content, your landers, your messages to registrants or your breach of these terms or of data protection law.

These terms are governed by the laws of Malaysia. We will always try to resolve concerns informally first; if that doesn't work, the courts of Malaysia have jurisdiction.

We may update these terms from time to time. We will change the “last updated” date and tell users about significant changes by email or in the app. Continuing to use Bottega after a change means you accept the updated terms.
